This website, located at https://Geo-Surface.com (the “Site”), is operated GIS4AG (gis4ag.com) (“we,” “our,” or “us”). Geo-Surface.com is a platform under the GIS4AG umbrella. By accessing or using the Site and its Services, you acknowledge and agree to the following Terms of Service (“Terms”).

By accessing or using the Site or any related services (collectively, the “Services”), you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

Geo-Surface.com provides web-based elevation, terrain, and drainage-design tools (the “Tools”) for informational and educational purposes, including but not limited to:

  • LiDAR-based mapping
  • Flow route computation
  • Drainage design tools
  • Tutorials and user guides
  • Subscription or membership-based services

3. Ownership & Sole Proprietorship

  1. Operator Information: The Site and Services are owned and operated by GIS4AG.
  2. Branding: Geo-Surface is a product name, trade name, or service name used under GIS4AG and is not a separate legal entity.

4. Modifications to the Terms

We reserve the right to modify or replace these Terms at any time. You will be notified of major changes by an announcement on the Site or by email. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

5. User Eligibility & Accounts

  1. Eligibility: You must be of the age of majority in your jurisdiction or older to access or use our Services.
  2. Account Registration: Creating an account may be required for certain features. You agree to provide accurate and complete information and keep it updated.

8. Subscriptions & Payments

  1. Membership Fees: Some functionalities require a paid subscription or membership. The applicable fees will be clearly outlined at the time of purchase.
  2. Billing & Renewals: Memberships may renew automatically unless canceled. You must ensure timely payment for uninterrupted service.
  3. Refunds: Refund policies, if any, will be stated separately. Requests are handled on a case-by-case basis, at our discretion.

9. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Province of Manitoba, Canada, without regard to conflict-of-law provisions. Any disputes shall be resolved exclusively in the courts located in Manitoba.

10. Termination

We may terminate or suspend access to the Services immediately for any misconduct, breach of these Terms, or other actions detrimental to the operation of the Site or Services.

11. Severability

If any provision of these Terms is deemed unenforceable, all remaining provisions shall remain in effect.
